Terms & Conditions
1. General
All prices are based on current market rates and are subject to change. Adjustments may occur due to fluctuations in material costs, fuel charges, labor availability, or other unforeseen factors beyond our control.
If, at any point before or during the course of work, required materials, supplies, or resources must be sourced from an alternate provider, at a higher rate, or from a more distant location, the client may be billed for the difference. This may include increased purchase costs, delivery fees, or extended travel necessary to obtain materials. Superior Landscaping LLC will make reasonable efforts to notify the client of significant changes prior to completion of work.
2. Estimates & Revisions
All estimates are provided as good faith projections based on the information available at the time of inspection. Final costs may vary depending on site conditions, changes in scope, or unforeseen challenges. Any revisions will be communicated to the client for approval prior to completion.
3. Scope of Work
Only the services specifically listed in the approved quote will be performed. If a service is not itemized in the quote, it is not included in the scope and will not be completed. This includes tasks that may be assumed or appear related but are not explicitly mentioned. Any additional work requested by the client that falls outside of the listed services will require a revised estimate and written approval or may be subject to a separate agreement.
4. No Guaranteed Service
Accepting or signing a quote does not guarantee service or establish a Contractor-Client relationship. Services are not confirmed or scheduled until a formal service date is agreed upon and written confirmation is provided via email or text. This applies to all services, including one-time jobs. For recurring services and snow removal, a signed contract is required before any work will begin. In some cases, a separate agreement may also be necessary for one-time or specialized projects. Without written confirmation and/or the required contract, no service will be performed, regardless of quote acceptance.
5. Payment Terms
All invoices are due within seven (7) days of the service date (NET 7). Late payments are subject to interest charges in accordance with the maximum rate permitted under Connecticut state law. Failure to remit payment on time may result in suspension of services and/or legal collection actions.
6. Cancellation & Rescheduling
Clients must provide at least 48 hours' notice for cancellations or rescheduling. Short-notice cancellations may result in a cancellation fee or forfeiture of the scheduled service. Superior Landscaping LLC reserves the right to reschedule due to weather, equipment issues, or other unforeseen circumstances.
7. Weather Delays
Services may be delayed due to inclement weather or unsafe working conditions. Weather-related delays do not void this agreement but may postpone service for an undetermined period until conditions are suitable to resume work and the schedule allows.
8. Property Access & Preparation
Clients are responsible for ensuring the property is accessible and ready for service on the scheduled date. This includes unlocking gates, removing obstructions, and securing pets. If our crew is unable to access the work area or conditions are unsafe, the service may be rescheduled and a trip charge may apply.
9. Disposal of Materials
Handling of debris will be determined on a job-by-job basis and outlined in the estimate. If off-site disposal is required, it will be itemized in the estimate with an estimated rate. Clients requesting debris be left on-site (e.g., for personal compost or firewood) must specify this at the time of estimation. Additional disposal fees may apply if the volume of material exceeds typical service amounts.
10. Permits & Approvals
Superior Landscaping LLC will obtain and comply with any permits or requirements mandated by the municipality for the scope of work. The client is solely responsible for securing all other necessary approvals, including but not limited to homeowner associations (HOAs), condo associations, property management companies, or private community boards. Superior Landscaping LLC will not be held liable for delays, fines, or additional costs resulting from the absence of such approvals.
11. Liability for Unknown Hazards
Superior Landscaping LLC is not liable for any damages to underground or concealed hazards not clearly marked or disclosed in advance. This includes, but is not limited to, irrigation systems, non-utility electrical wires, abandoned tanks, sinkholes, drainage systems, or any unmapped infrastructure. It is the client’s responsibility to inform us of known risks prior to the commencement of any work.
12. Service Limitations
All work will be performed using standard industry practices. Superior Landscaping LLC is not responsible for results impacted by conditions outside our control, including soil composition, existing lawn health, drainage issues, or weather-related effects.
13. Warranty & Guarantee
Superior Landscaping LLC does not provide warranties or guarantees beyond what is explicitly stated in writing. Plantings, sod, and other living materials are not guaranteed due to variables outside our control, including weather, watering, soil, or maintenance practices.
14. Client Responsibilities
Clients are responsible for ongoing care and maintenance following service. Failure to follow recommended care guidelines may affect results and void any limited guarantees.
15. Limitation of Liability
Superior Landscaping LLC’s liability for any claim arising out of services rendered shall not exceed the total amount paid by the client for those specific services.
16. Photos
Photos may be taken before, during, and after service or at the time of estimate. These images are primarily for internal documentation, proof of service, and to record the completed stages of a project for quality assurance and reference.
From time to time, photos may also be used for marketing or advertising purposes (such as on our website, social media, or promotional materials). In such cases, Superior Landscaping LLC will ensure that no identifiable client information, addresses, or sensitive property details are disclosed. Images will focus solely on the work performed and its results.
If a client reasonably requests that a publicly posted photo of their property be removed, Superior Landscaping LLC will honor the request and remove the image.
17. Changes to Terms
Superior Landscaping LLC reserves the right to update or modify these terms at any time. The most current version will be made available upon request or listed on our website.
